Shipping Policy

Applicability: The conditions mentioned here apply to the carriage by MASHA, this consignment note covers all the shipments booked under it within the territory of India whether they are transported using a single transport or multiple. These terms and conditions have an overriding effect over any other terms or conditions or an agreement (oral or written). The customer confirms and agrees that they are not relying upon any other terms, warrants, conditions, or representations relating to the use of services provided by MASHA. The rights and liabilities of the parties and MASHA will be governed in accordance with the terms and conditions which are mentioned below and this will be a binding contract on MASHA as well as the parties.

  1. Definitions:
    1. Delivery” means tendering of a consignment to a recipient or intimation about arrival of the consignment to a recipient at the destination.
    2. “MASHA” means its channel partners or authorized representatives.
    3. “Parties” means and includes Sender & Recipient or their authorized representatives.
    4. “Sender” means the person or organization tendering a consignment to MASHA for delivery and “Recipient” means the person or an organization entitled to receive the consignment.
    5. “Shipment” or “Consignment” means a document or a non document booked under a consignment note by the parties irrespective of the number of packages, value, commodity etc.
    6. “Freight” means the transportation charges alone, and it excludes taxes and any specific charges applicable for any value-added services.
    7. “Declared value for carriage” shall mean the value assigned by the sender for the purposes of unrecoverable damage to or loss of consignment while the same is in the custody of MASHA. “Declared value for Carriage” shall be applicable when the sender insures the goods externally and chooses “Owner Risk” and also when the consignment is opted to be covered under “Carrier Risk.”
  2. The parties confirm that this consignment note is drafted by the sender (party itself) or by a MASHA staff who is drafting it under the instruction of the Parties and the conditions mentioned in this are binding on the parties.
  3. This consignment note is issued based on the information provided by the parties during the time of booking and they will be responsible for any consequences that may arise because of providing any false or wrong information.
  4. The complete address of the sender and recipient and a valid contact number should be provided by the sender along with the correct PIN Code. Any service failure that happens because of providing wrong or incorrect information mentioned above shall be the responsibility of the parties.
  5. The Parties agree that the services provided by MASHA under this Consignment Note are based on the condition that the Parties make payment of freight and all other charges which arise in respect of the consignment.
  6. The parties will make all the payments that will arise due to rules of statutory bodies or Municipal or State/Central Government agencies with regards to the consignment during the time of transit or time of delivery.
  7. If a difference in weight is found after accepting a consignment and the actual weight is more than what was declared, the parties will be charged with respect to the difference in the weight.
  8. If a consignment is held up by authorities like Goods and Services Tax, Excise, Customs, Check-Post officials, etc., MASHA is not responsible for any losses or for refunding the freight charges. The Parties agree to compensate MASHA for any losses, including taxes, fines, and penalties, caused by insufficient documents or wrong declarations. The Parties will also cover the charges of any claims from other entities affected by delays related to these consignments.
  9. It is the sender’s duty/obligation to pack and label the package properly for the purpose of shipping with normal care.
  10. Items not allowed for transport: The Parties accept that the consignment will not ship or transport any item restricted for courier transport, illegal goods, or anything that could cause safety hazards as specified by the current IATA DG regulation.
  11. Perishable Items: Parties agree not to send any items that will spoil in less than 7 days. MASHA will not be responsible for any loss or damage to such items if there is a delay in delivery of the said good.
  12. Inspection of Consignment: MASHA has the right to open and inspect consignments at any time, either by choice or at the request of authorities, during the acceptance process, at MASHA handling points, at airline security gates, or if requested by any official agencies.
  13. MASHA will not deliver consignments to PO Box addresses. For drop-box deliveries to places like ministry offices, armed forces establishments, certain government offices, and high-security zones, MASHA will not provide proof of delivery. The parties must accept the information provided as final.
  14. Limited Liability for Delay: If your package is delivered late, MASHA will not be responsible for any indirect or additional losses, such as loss of income, profits, or any claims by other parties affected by the delay.
  15. MASHA's Liability Policy: If your package is damaged, lost, or delivered to the wrong address, MASHA will only compensate you up to Rs. 100. However, if you want more coverage, you can declare a higher value for your package and pay an extra fee for "Carriers Risk" when you send it.
  16. Risk Surcharge:
    1. If you have your own insurance for the package, you must declare this on the consignment note as "Owner Risk" and pay the related surcharge when sending the package. If the package is damaged or lost during transit, MASHA will provide a "Certificate of Facts" (COF). In cases where the package is externally insured, the sender agrees not to transfer their rights to the insurance company if they receive any claim amount from them.
    2. If the sender chooses to transport the package under "Carrier Risk," they must pay a Risk Surcharge based on the charges listed below.
    3. The Risk Surcharge for "Owner Risk" or "Carrier Risk" will be calculated based on either the minimum charges or a percentage of the Declared Value for Carriage, whichever amount is higher. Service Tax will also apply to the Risk Surcharge.

    4. Under "Owner Risk," the minimum Risk Surcharge is Rs. 25 or 0.2% of the Declared Value for Carriage (DVC), whichever is higher, for consignments valued up to Rs. 1,00,000. For consignments valued between Rs. 1,00,001 and Rs. 5,00,000, the surcharge is 0.1% of the DVC. MASHA will not accept consignments with a DVC above Rs. 5,00,000 under "Owner Risk." Under "Carrier Risk," the minimum Risk Surcharge is Rs. 50 or 2% of the DVC, whichever is higher. For consignments with a DVC between Rs. 1,00,001 and Rs. 2,00,000, the surcharge is 1% of the DVC. MASHA will not accept consignments with a DVC above Rs. 2,00,000 under "Carrier Risk."
    5. If the "Declared Value for Carriage" is not specified on the Consignment Note when tendering a package to MASHA, MASHA's liability will automatically be limited to a maximum of Rs. 100 per consignment or the value of the goods, whichever is lower.
    6. Fragile or breakable items like TV sets, glass or porcelain articles, glassware, and high-value items such as crystals, paintings, antiques, and perishable goods are not covered under "Carrier Risk." MASHA's liability for shipping these items is limited to a maximum of Rs. 100.
    7. The “Declared Value for Carriage” must be less than or equal to the value of goods.
  17. All claims for loss or damage of a consignment must be made within 30 days from the date the consignment was given to MASHA. Claims submitted after this period will not be considered. Similarly, requests for freight refunds will not be accepted beyond 30 days from the shipping date.
  18. Freight refunds will not be granted if the service failure is due to Force Majeure conditions, such as strikes, protests, elections, heavy rains, floods, fires, accidents, or other natural disasters. This also includes events beyond MASHA's control, like road closures, traffic diversions during festivals or rallies, and inspections by authorities such as Excise, Customs, or Sales Tax agencies.
  19. The parties must pay the freight and other charges when booking or within the specified credit period. If payment is not made on time, interest will be charged at 24% per year. Freight invoices will be issued according to the agreed billing cycle in the service contract between the parties and MASHA.
  20. If the parties do not take delivery of the consignment, or if it remains undelivered due to reasons such as an incorrect or incomplete address, refusal to pay applicable duties or charges, prohibited items, damaged packaging, or potential harm to other goods or people, they are still responsible for paying the freight and other charges to MASHA. If the consignment remains undelivered for more than 48 hours from the delivery attempt, demurrage, or warehouse charges of 0.1% of the consignment’s invoice value per day will apply, or at rates set by MASHA. If the consignment is not claimed within one month from the first delivery attempt, MASHA has the right to sell the goods to cover its dues.
  21. The parties cannot deduct or adjust any amounts owed to MASHA due to claims related to lost tax invoices, waybills, delivery chits, or similar documents. However, MASHA will provide reasonable help to reconstruct duplicate copies of these documents if possible.
  22. MASHA has a general lien, in addition to a Carrier’s lien, on all consignments it holds. This means MASHA can retain possession of the consignments until any payments due from the parties, including freight charges, duties, taxes, or other related charges, are fully paid.
  23. The directors, owners, partners, and shareholders of MASHA are not personally responsible for any claims or liabilities resulting from service failures due to mistakes, omissions, or misleading information provided by MASHA's employees, channel partners, or authorized agents
  24. Any disputes or claims related to the consignment or the terms of this agreement between the parties and MASHA will be settled through arbitration. Each side will appoint one arbitrator, and these two arbitrators will then appoint a third arbitrator by mutual agreement. The arbitration will take place only in Bangalore. Only the courts in Bangalore will have the authority to handle any legal matters related to this agreement.
  25. The consignment note is not a tax invoice. A tax invoice will be made available by MASHA or its’ channel partner as the case may be, upon request.
  26. All domestic orders may take approximately 5-7 business days and international orders may take approximately 7-11 business days for delivery from the date of dispatch.
